Mr. Pawan Kr. Gupta Sofia Nesar Mr. Santanu Sett … For the Opposite Parties
The opposite parties are represented. None appears for the petitioner. No accommodation is sought. Learned counsel for the opposite parties produces documents to demonstrate that the direction given vide order dated 26th September, 2024 has been complied with. It appears that on two earlier occasions, this Court directed expeditious disposal of the application under Section 12 of the Protection of Women from Domestic Violence Act, 2005 within a stipulated time frame, on 16th March, 2021 in CRR 1437 of 2020 and on 9th July, 2024 in CRR 2450 of 2024. This Court is informed that the case is still pending. In view of the above, learned trial Court is directed to take the proceeding under Section 12 of the Act of 2005 to its logical conclusion within three months from the next date of hearing fixed before him without granting any unnecessary adjournment to either of the parties, in accordance with law. The said time frame is peremptory and mandatory. The revisional application is dismissed. Urgent certified website copy of this order, if applied for, be given to the parties, upon compliance of requisite formalities.
