ORAL ORDER After arguing for some time, learned advocate for the applicant, under instructions, seeks permission to withdraw the present application, with liberty to raise all available contentions before the trial Court at the time of arguments on the evidence of PW-1 (Para 19, Exh:43). Since the learned Sessions Court has rejected the objections, the applicant shall be at liberty to raise all contentions, including those relating to the admissibility and relevancy of facts, in light of the law laid down in Venkatesh (Chandra) v. State of Karnataka, reported in (2005) 7 SCC 714. The trial Court shall consider and decide the contentions independently, on their own merits, at the stage of appreciation of evidence, without being influenced by this
order. Permission as prayed for is granted. With above liberty, present petition is disposed of as withdrawn. It is made clear that this Court has not examined the merits of the case.
