ORDER:
The instant petition under Section 482 of the Code of Criminal Procedure, 1973 (in short, “Cr.P.C.”) has been filed by the Petitioner/ Accused No.2, seeking quashment of the proceedings pending against him in C.C.No.180 of 2019 on the file of Court of III Additional Chief Metropolitan Magistrate, Gajuvaka, Vishakhapatnam.
2. Heard Sri Devarayalu.B.S., learned Counsel for the petitioner and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.

Learned counsel for the petitioner would submit that the petition may be
disposed of without causing any prejudice to the rights and contentions of the petitioner, by dispensing the presence of the petitioner/A2 before the Trial Court.
4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders.
5. Considering the submissions made, the Criminal petition is disposed of without causing any prejudice to the rights and contentions of the petitioner. However, the presence of the petitioner/A2 before the Trial Court is dispensed with unless his presence is specifically directed by the Trial Court. However,

the petitioner is at liberty to raise all the contentions before the Trial Court in his defence.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
