3. Per contra, learned Public Prosecutor has vehemently opposed the bail application. It is submitted that bail application of the co-accused has been rejected. It is further submitted that there is recovery of blood stained hammer, motorcycle and there is motive of murder qua the applicant.
4. Considering the arguments advanced by the counsel for the parties, considering that there is motive of murder and recovery of blood stained hammer is from the accused-applicant; that bail of the co-accused has been rejected; and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is not inclined to allow the bail applications of the accused- applicant.
5. Accordingly, the bail application under Section 483 BNSS is dismissed (SAMEER JAIN),J Pooja /18
