WRIT PETITION No.31818 OF 2018
ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
“….to issue a writ, order or direction, more particularly one in the nature of Writ of Mandamus, the action of the respondents 2 to 4 herein, in harassing Petitioner by interfering with peaceful enjoyment of petitioner life and personal liberty as illegal, improper, unjust and contrary to law and violation of Article 21 of the Constitution of India and consequently direct the respondents herein not harass petitioner by interfering with petitioner peaceful enjoyment life and personal liberty and pass…”
2. Heard Sri Challa Ajay Kumar, learned counsel for the writ petitioner and learned Assistant Government Pleader for Home. 3. The contention of the petitioner is that in the year 2018, he was summoned to the police station unnecessarily without there being any case registered against the petitioner. Therefore, the writ petitioner filed the present petition to direct the police not to harass the petitioner illegally. 4. Considering the above facts and circumstances, which relates in the year 2018 and as no allegation that still they are harassing the petitioner as on today also, this Court is of the considered opinion that the writ petition can be disposed of at the stage of admission, without going into the merits of the case, with an observation that the police shall follow due procedure established by law, if they intend to call the
3 petitioner for the purpose of enquiry/investigation relating to any offence. 5.
5. Accordingly, the Writ Petition is closed. There shall be no order as to costs. As a sequel thereto, interlocutory applications, if any, pending in this Writ Petition shall stand closed. ______________________________ JUSTICE B.V.L.N. CHAKRAVARTHI 06.08.2025 Pmk
