ORAL ORDER
1. Learned Advocate Mr. Darshankumar Kabra for the plaintiff has tendered a Withdrawal Purshish dated 20.05.2025 and submitted that the Plaintiff has received the claim amount as and by way of security from the disponent owner and/or person interested in the defendant vessel. Learned Advocate further submitted that the parties have agreed to resolve their disputes through arbitration as is provided in the Charter Party and in view thereof, the plaintiff does not wish to prosecute the present admiralty suit further and seeks permission to unconditionally withdraw it. Purshish dated 20.05.2025 is directed to be taken on record and
C/AS/27/2025 ORDER DATED: 20/05/2025 shall form part of this order.
2. In view of the purshish filed by the Learned Advocate for the Plaintiff, the suit is disposed of as withdrawn. The order dated 17.05.2025 stands vacated and Defendant Vessel is directed to be released forthwith. The registry is directed to issue release warrant forthwith.
3. The Registry is directed to refund permissible court fees in the name of the learned advocate for the plaintiff.
