This application under Section 483 Cr.P.C. has been filed with a prayer to direct the learned trial court to decide Case/F.R. No. 235 of 2020 (Munni Devi Vs. Soni and others), arising out of Case Crime No. 224 of 2019, under Sections 147, 149, 302 I.P.C., Police Station Shahpur, District Gorakhpur, pending in the court of learned Additional Chief Judicial Magistrate, Gorakhpur, expeditiously within a stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the applicant before this Court is informant. It is further submitted that earlier after investigation, police submitted final report. The applicant filed protest petition which was admitted and final report was rejected and an order for further investigation was passed by the court of learned Chief Judicial Magistrate, Gorakhpur vide order dated 15.12.2021 and since then no report has been submitted by the police so far. 4. Learned A.G.A. opposed the prayer. 5. I have considered the submissions and perused the record. 6. In the facts and circumstances of the case, the learned Chief Judicial Magistrate, Gorakhpur is directed to avail the powers of the courts provided under law to monitor the investigation and after submission of police report in Case/F.R. No. 235 of 2020 (Munni Devi Vs. Soni and others), arising out of Case Crime No. 224 of 2019, under Sections 147, 149, 302 I.P.C., Police Station Shahpur, District Gorakhpur, pending in the court of learned Additional Chief Judicial Magistrate, Gorakhpur proper order shall be passed by him within a period of two months from the date of production of certified copy of this order. 7.
