2 Hon'ble Shri Arvind Kumar Verma, Judge
Order on Board 06.08.2025
1. The instant petition has been filed by the petitioner on the following relief (s) :
“10.1 That, respondent no.2 be directed to pass appropriate order based upon the investigation report dated 18/06/25. 10.2 That, respondent no. 2 and 3 be directed to take action against 5,6 and 7 under UIDAI's guidelines. That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate.”
2. Learned counsel for the petitioner contented that this writ petition is being preferred regarding an inquiry investigation completed on the basis of the complaint made by villagers along with petitioner on 18/06/2025 regarding charging of extra money for updating Aadhar work in Gram Panchayat Ara and report has been submitted to S.D.O on 18/06/2025. An investigation was conducted by the Tehsildar (respondent no 4) and Sub Divisional Officer (respondent no 3) regarding illegal collection of money from approximately 900 ration card holders in name of adding mobile number top the ration card by respondent even after no 5. No
order has been passed by the collector submitting the inquiry report. Hence, this petition.
3. Learned State counsel opposes the submission made by the learned counsel for the petitioner.
4. I have heard learned counsel for the parties and perused the material
3 available on record.
5. Considering the facts and circumstances of the case and submission made by learned counsel for the parties, on perusal of the order dated 14.07.2025 passed by the Sub Divisional Officer (Revenue), Rajpur, I have found the relevant para of the said order as under :
6. Looking to the above, it is crystal clear from the record that proceeding under Section 40 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993 has already been initiated by the SDO (R), Rajpur, District Balrampur, hence, the petitioner may raise his grievances before the SDO (R), Rajpur, District Balrampur (C.G.), if so desire.
7. With the aforesaid observation and direction, the writ petition is disposed of.
