ORDER (Order of the Court was made by the Hon'ble Chief Justice) This is one of those perfect examples of abuse of process of Court by the litigant who wants to use the contempt petition route and public interest litigation route for personal gains. This petition was filed alleging wilful disobedience of the order passed by this Court by respondents. __________ https://www.mhc.tn.gov.in/judis

2. In the contempt petition, paragraph 4 reads as under:
“4. Hence, the petitioner was constrained to issue a contempt notice dated 22.6.2024 to the respondents calling upon the respondent to comply the order passed by this Honourable court in the above referred writ petition within a specified time. On receipt of notice, the 1st respondent forwarded the same to the respondent No.2 to 4 for taking an appropriate action. It is further directed to sent action taken report vide letter dated
11.7.2024. To date, several months passed. However, the respondents have not taken any steps even after receipt of notice and direction from the 1st respondent. The petitioner is running from pillar to post. There was no response from the respondents. Thus, the respondents have wilfully disobeyed order of this honourable High Court made in the above writ petition. The respondent has to be punished under the contempt of court Act.”
3. Shri. Prabakar appearing for all respondents tenders two documents, one of which is dated 05.07.2024 addressed to petitioner, by which petitioner was directed to remain present for conducting a survey/inspection/enquiry (visaranai) on 15.07.2024 at 11 a.m. Petitioner's signature is also on the records of the said letter acknowledging the receipt. Shri. Prabakar submitted that petitioner also attended and his statement was recorded on 15.07.2024. 4. When this was mentioned in the pre-lunch session, counsel for petitioner requested the matter be stood over post-lunch, so that he could take instructions. Post-lunch, Shri. Myilsamy was embarassed to confess that petitioner had indeed received the notice and petitioner had participated in the enquiry on 15.07.2024 and petitioner's statement was also recorded.
5. Therefore, it is obvious that petitioner has suppressed material
facts and what is stated in the affidavit that petitioner is running from pillar to post and there was no response from respondents are nothing but deliberate false statements.
6. When we informed Shri. Myilsamy that we would be not only dismissing the petition, but also initiate perjury proceedings against petitioner, Shri. Myilsamy sought leave to withdraw the petition and apologised to the Court because he was not instructed by petitioner.
7. We would allow Shri. Myilsamy to withdraw the petition which is hereby dismissed as withdrawn, but certainly petitioner has to be put to __________ https://www.mhc.tn.gov.in/judis

terms. Petitioner shall pay a sum of Rs.25,000/- (Rupees twenty five thousand only) as costs by way of donation to the Principal, Government Naturopathy Medical College bearing Account No.7883022723, IFSC No.IDIB000M157. This amount shall be paid by petitioner personally within two weeks from today, failing which, the District Collector may recover this amount from petitioner as arrears of land revenue.
8. Petition is dismissed as withdrawn.
