Neutral Citation No. - 2025:AHC:53002 Court No. - 76 Case :- MATTERS UNDER ARTICLE 227 No. - 3494 of 2025 Petitioner :- Sandeep Singh Respondent :- State Of Uttar Pradesh And Another Counsel for Petitioner :- Puneet Srivastava Counsel for Respondent :- G.A. Hon'ble Vinod Diwakar,J.
1. Heard learned counsel for the petitioner, learned A.G.A. for the State-respondents, and perused the material available on record.
2. The present writ petition has been filed seeking quashing of the
order dated 24.01.2025 passed in Criminal Appeal No. 68 of 2023 titled Sandeep Singh v. State of U.P. by the learned Additional District and Sessions Judge/Special Court (E.C. Act), Aligarh, and the order dated 14.03.2023 passed in Case No. 8350 of 2022 (Computerized Case No. 0202218020008350) titled State v. Sandeep Singh, under Section 6-A of the Uttar Pradesh Essential Commodities (Special Provisions) Act, 1955, by the Additional District Magistrate (Administration), Aligarh Division, Aligarh.
3. Learned counsel for the petitioner submits that a report was submitted by the District Supply Officer dated 18.11.2022 in Case Crime No.0477 of 2022, pursuant to which a notice dated 22.11.2022 was issued to the petitioner. It is the petitioner's contention that a reply was duly submitted in response to the said notice; however, the authority failed to consider the same and proceeded to seize the goods in question arbitrarily. It is further submitted that despite raising valid grounds in the appellate proceedings, the appeal was dismissed vide order dated 24.01.2025, thereby causing prejudice to the petitioner.
4. Per contra, learned A.G.A. appearing on behalf of the State has opposed the petition and contended that both the orders impugned herein have been passed after due consideration of the material on record. It is submitted that the authorities have acted within the ambit of law, and no interference is warranted in exercise of writ jurisdiction.
5. Upon thoughtful consideration of the rival submissions and careful perusal of the impugned orders dated 14.03.2023 and 24.01.2025, this Court does not find any procedural irregularity, jurisdictional error, or perversity in the approach adopted by the authorities. The record clearly reveals that 87 kilograms of rice packed in 118 bags- intended for public distribution- were recovered from the possession of the petitioner.
6. In the given background, and in the absence of any manifest illegality or arbitrariness, this Court finds no ground to invoke its extraordinary writ jurisdiction under Article 226 of the Constitution of India.
7. The present writ petition is devoid of merit, and is accordingly, dismissed.
