The petitioner is apprehending his arrest in connection with Deori P.S. Case No. 90 of 2024, registered for the offences under Sections 338, 336(3), 340(2) and 317(5) of Bharatiya Nyaya Sanhita, 2023, Section 4/21 of the Mines and Minerals (Development and Regulation) Act, 1957, Rule-4/54 of Jharkhand Minor Mineral Concession Rules, 2004, Rule 7/9/13 of the Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rules, 2017, pending in the court of learned Judicial Magistrate, 1st Class, Giridih.

Learned counsel appearing for the petitioner submits that the petitioner has earlier moved before this court in A.B.A. No. 1330 of 2025, which was dismissed as withdrawn by order dated 27.02.2025. He next submits that there is change in the circumstance, due to that the present petition has been filed.

Learned A.P.P. appearing for the State has opposed the prayer and submits that there is no change circumstance and what has been disclosed in the present petition is already there at the time of withdrawal of earlier application.

In view of the above and considering the fact that nothing new has been disclosed in the petition, I am not inclined to grant anticipatory bail to the petitioner, named above. As such, this petition is dismissed.
