ORDER:
Heard Sri Kumar Etukuri, learned counsel for the petitioner, and the learned Assistant Government Pleader for Mines and Geology for the respondents. 2

Challenging the action of the respondents in permitting the unofficial respondent to excavate gravel in Survey No.131 of Narasingapalem Village, Agiripalli Mandal, Krishna District, the Writ Petition is filed. 3. It is contended by the petitioner that the subject land in Survey No.131, is used as a graveyard by the community people and there are existing graves, and that there is a church in the same locality. However, the permission was granted for the excavation of gravel which is causing damage to the existing graves and the church. 4. The 4th respondent filed a counter affidavit stating that after obtaining no objection from the respective local authorities, the license was granted. It is further stated that the lease was granted for a period of three (3) years w.e.f.,04.04.2017, and it is further stated that as on the date of filing of the counter affidavit, no further extension of lease has been granted in respect of the subject land in Survey No.131. If any future proposals for issuance of lease, the same will be done after obtaining no objection from the concerned revenue, panchayat and environmental departments after following due procedure, the license would be granted. 5. It is thus stated by the learned counsel for the petitioner that the cause does not survive and no further orders are required to be passed in the present Writ Petition. 3
6. Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. As a sequel, all pending miscellaneous applications shall stand closed.
