The petitioner is apprehending his arrest in connection with Pipra P.S Case No. 62 of 2024 for the offences registered under section 82(1), 351(2), 105, & 3(5) of B.N.S pending in the court of learned J.M.F.C, Palamau, Jharkhand. 3. Learned counsel appearing for the petitioner submits that only allegation against the petitioner is that the petitioner had not provided better treatment to his wife who died due to HIV positive. He further submits that petitioner is also HIV positive and there is no allegation of torture and assault upon the wife. 4. Learned counsel appearing for the State opposes the prayer and submits that the petitioner is also HIV positive. 5. Looking into the contents of the FIR, it transpires that only allegation made against the petitioner is that the petitioner has not ( 2025:JHHC:35933 ) --2-- provided better treatment to his wife. It has come in the case diary that death of the wife of the petitioner occurred due to HIV positive, and that has come in the order of the learned Sessions Judge and in the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned, J.M.F.C, Palamau, Jharkhand, in connection with Pipra P.S Case No. 62 of 2024 subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. 01.12.2025 (Sanjay Kumar Dwivedi, J.)
