Heard the parties.
The petitioner has been made accused in connection with Jama P.S. Case No. 44 of 2025, for the offence under Sections 274, 275, 292, 319(2), 318(4), 338 & 336(3) of the B.N.S. and Sections 47(a)(b)(c), 52(d) and 55 of the Excise Act, pending in the court of learned C.J.M., Dumka.
On 31.07.2025, Jama Police on the basis of confidential information raided the house of Sachin Kisku and recovered huge quantities of foreign liquor from there. Petitioner and co-accused persons were found running away from the place of occurrence.
It was submitted that petitioner had gone to meet Sachin Kisku and he was present at the wrong place at the wrong time. On seeing the police party, he became afraid and fled away. It was further submitted that nothing has been recovered from the conscious possession of the petitioner.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Dumka, in connection with Jama P.S. Case No. 44 of 2025.
