Heard learned counsel for the petitioners and learned Standing Counsel appearing for the State-respondents. 2. This Court, vide order dated 17.4.2025, passed the following order: "1. Mr. Rajesh Mishra, learned advocate holding brief of his senior, appears on behalf of the petitioners and submits that vehicles transporting sand illegally are passing over his clients' agricultural land. In spite of his clients having made representations dated 3rd February and 10th March, 2025, the vehicles continue to pass over the land. 2. Mr. Devesh Mishra, learned advocate, Additional Chief Standing Counsel, appears on behalf of the State. 3. Respondent No. 3 is directed to make an inquiry on the evidence of vehicles passing over the petitioners' agricultural land as described in the prayer and in the petition. Report be filed on the adjourned date. Sand- laden vehicles passing over agricultural land will leave tyre tracks. Mr. Vikram is requested to communicate the website copy of this order to the said respondent. 4. List on 2nd May, 2025 as fresh." 3. Pursuant to the aforesaid order, Shri Sandeep Kumar Singh, learned Additional Chief Standing Counsel, on the basis of instructions, submits that a joint inquiry was conducted by the Sub-Divisional Magistrate, Sarila, Mining Officer, Hamirpur, Circle Officer, Sarila, Tehsildar, Sarila, Mining Inspector, Hamirpur, Revenue Inspector, Jariya, and the local Lekhpal of village Ichhaura. During the inquiry, the petitioners’ representative as well as local villagers were present. 4. And 3 Others .....Respondent(s) herein below: 1- यह िक यािचकाकतार् द्वारा प्रस्तुत कथन िक गाटा संख्या-1133, 1135, 1137/1, 1138, 1139, 1148 एवं 1259 में अवैध खनन एवं प्रश्नगत गाटा संख्याओं से िबना सहमित प्राप्त िकये पिरवहन मागर् बनाये जाने के सम्बन्ध में प्रश्नगत सभी गाटा संख्याओं का संयुक्त जांच उपिजलािधकारी सरीला, खान अिधकारी हमीरपुर, क्षेत्रािधकारी सरीला, तहसीलदार सरीला, खान िनरीक्षक हमीरपुर, राजस्व िनरीक्षक जिरया व क्षेत्रीय लेखपाल इछौरा द्वारा िकया गया। जांच के दौरान मौके पर यािचकाकतार् भतीजा श्री जगभान ग्राम इछौरा िजटकरी, श्री आिदत्य, रुपेश (ग्रामवासी) एवं पट्टाधारक प्रितिनिध श्री सिचन िसह उपिस्थत थे। जांच आख्या िदनांक-25.04.2025 (संलग्नक-1) द्वारा अवगत कराया गया है िक उपरोक्त िकसी भी गाटा संख्याओं पर िकसी प्रकार का कोई भी खनन कायर् नहीं िकया गया है। यािचकाकतार् की भूिम गाटा संख्या -1133, 1135, 1137/1, 1138, 1139, 1148 एवं 1259 बालू/मौरम लदे वाहनों के पिरवहन से सम्बिन्धत कोई भी साक्ष्य नही िमले। यािचकाकतार् द्वारा अपनी भूिम पर िनयिमत रूप से खेती की जा रही है, िजसकी प्रवृिष्ट क्षेत्रीय लेखपाल द्वारा िनयिमत रुप से आनलाइन खसरा (संलग्नक-2) में दशार्यी गयी है। याची अपनी भूिम पर कािबज है तथा कृ िष कायर् कर रहा है। यािचकाकतार् द्वारा की गई प्राथर्ना जांच में सही नहीं पायी गई। 5. The aforesaid instructions clearly state that no mining activity was carried out on the petitioners’ plots and no evidence of sand-laden vehicles passing over the same was found. On the contrary, the petitioners were found in possession of their land and regularly carrying out agricultural activities, which fact is reflected in the online revenue records. 6. In view of the above, the allegation that vehicles are illegally passing over the agricultural land of the petitioners gives rise to a disputed question of fact, which cannot be adjudicated by this Court in exercise of jurisdiction under Article 226 of the Constitution of India. 7.
