This is the first bail application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the applicant, who is apprehending his arrest in connection with Crime No.236/2024 registered at Police Station Janakpur District- Manendragarh (C.G.) under Sections 318(4), 338, 336(3), 340(2) of BNS. 2. Case of the prosecution, in brief, is that the complainant before the Police Station – Janakpur that when he inquired temporary sand storage of the license applicant, which is situated at village Chidoula VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.08.08 11:12:43 +0530
2 police Station Janakpur District- - MCB (C.G.) then he found applicant was using forged mineral transport passbook no.5743 from serial No.5721251 to serial No.57521275 total nos. of pages 25. on the written complaint of the complainant FIR was registered under Section 318(4), 338, 336(3), 340(2) of BNS and investigation is going on. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and due to political rivalry, and because the applicant did not fulfill illegal demand of the complainant. He further submits that the applicant is a license of temporary sand storage Chidoula, license has been issued by the office of the Collector, Mining Branch District- Manendragarh- Chirmiri-Bharatpur (C.G.), copy of the same herewith markes as Annexure-A/6, investigation and the conclusion of the trial is likely to take quite long time. Therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned counsel for the State/non-applicant opposes the prayer for grant of anticipatory bail and submits that the applicant has six previous criminal antecedents of IPC. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6.
Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the fact that applicant is a license of temporary sand storage Chidoula, District- Manendragarh-Chirmiri-Bharatpur (C.G.), further the conclusion of the trial may take some more time, this Court is of the view that the applicant is entitled to be released on bail in this case. 3

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Arvind Pratap Singh on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) The applicant shall not involve himself in any offence of similar nature in future. sd/- (Ramesh Sinha)
