Petitioners have been made an accused in connection with Nimiyaghat P.S. Case No. 91/2024, registered for the offences under Section 303(2)/ 317(5)/ 112(2)/ 271/ 272/ 275/ 210 of B.N.S. 2023, pending in the Court of Shri Danish Nawaz, learned Judicial Magistrate, 1st Class, Giridih. Petitioner No. 1 Mohesh Dhara, was transporting the seized fish in vehicle bearing registration number WB-19-K-7783, while petitioner no. 2, Tarun Kumar Bar is driver and petitioner no. 3 Alok Kumar Manjhi is cleaner of the said vehicle, which was seized by Nimiyaghat police from a place near Khairatunda and seized about 03 tons of Thai Mangur fish. It was submitted that the petitioner No. 1 Mohesh Dhara, was transporting the seized fish. It was further submitted that the driver and cleaner were working on the instruction of the petitioner No. 1 Mohesh Dhara. Regard being had to the facts and circumstance of the case and considering the nature of allegation; I am not inclined to enlarge the petitioner No. 1 Mohesh Dhara on bail. Accordingly, his prayer for bail is hereby rejected. As far as the petitioner no.2 Tarun Kumar Bar and petitioner no.3 Alok Kumar Manjhi are concerned; I am inclined to enlarge them on bail. They are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of Shri Danish Nawaz, learned Judicial Magistrate, 1st Class, Giridih or his successor in connection with Nimiyaghat P.S.
