The petitioner is apprehending his arrest in connection with Kadma P.S. Case No.137 of 2024 for the alleged offences registered under Sections 103 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned S.D.J.M., Jamshedpur. 3. Learned counsel appearing for the petitioner submits that only on suspicion the name of the petitioner has been inserted in the FIR. He further submits that in the postmortem report it has come that the death has occurred due to asphyxia as a result of hanging, however, viscera has been preserved for chemical analysis. He then submits that the petitioner happened to be a friend of the deceased. On these grounds, he submits that the anticipatory bail 2025:JHHC:34757 --2-- A.B.A. No. 5507 of 2025 may kindly be granted to the petitioner. 4. Learned counsel appearing for the State opposes the prayer and submits that the person who was the neighbour namely Riyaz Ansari has stated that certain altercation took place on the date of incident between the petitioner and the deceased. He submits that in the case diary it has come that on the date of incident the mobile location of the petitioner and the deceased was on the same place. 5. Considering that the relationship of petitioner along with the deceased has been stated by one neighbour namely Riyaz Ansari which has come in paragraph No.66 of the case diary and the mobile location of the deceased and the petitioner was also on the same place, I am not inclined to grant anticipatory bail to the petitioner, hence, the prayer for anticipatory bail of the petitioner is hereby rejected.
