This petition, filed under Section 439(2) read with Section 482 of the Code of Criminal Procedure, 1973, challenges the order dated 16.10.2023 passed by the First Additional Sessions Judge, Durg, in MJC No. 58/2023, whereby the petitioner's revision petition seeking cancellation of bail granted to Respondent No. 2 has been rejected, upholding the order dated 30.01.2023 passed by the Judicial Magistrate First Class (JMFC), Durg, wherein the petitioner's application for cancellation of bail has been rejected. 2. The accused, Shiv Kumar Verma, vide order dated 05.12.2019, has been granted bail by the trial Court in connection with Crime No. 503/2019 registered at Police Station Pulgaon, Police Chowki Jewra Sirsa, District Durg, under Sections 294, 506B, and 323/34 of the Indian Penal Code. 3. On 05.12.2019, the accused Shiv Kumar Verma, was granted regular bail by the trial Court. By now though five years have elapsed. It appears that, by afflux of time, there is no good ground to use inherent power under Section 482 of Cr.P.C. 4. In view of the above, the petition is dismissed.
