04/ 11.11.2025: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Gonda P.S. Case No. 47 of 2025, registered under sections 338, 336(3), 340(2), 61(2), 316(2), 111 of the BNS, 2023, pending in the Court of learned Judicial Magistrate, Ranchi.

Learned counsel for the petitioner submits that petitioner happens to be employee of Istruzion Edutech Service Pv.t Limited. He further submits that Sainwill Srivastava and Mainbil Srivastava are own brothers and Sainwill Srivastava is the director of the said company. He also submits that allegations are made that all the accused persons have convinced the innocent persons to invest 25% of the cost of laptop and two wheeler, car etc and those articles can be provided to the investors. He then submits that so far petitioner is concerned the case of the petitioner is similar to the case of Preeti Saxena who is wife of Sanwill Srivastava, who has been granted anticipatory bail by a Co-ordinate Bench of this Court in A.B.A. No. 3128 of 2025. He also submits that the case of the petitioner is on similar footing and in view of that petitioner may kindly be provided privilege of anticipatory bail. ( 2025:JHHC:33585 )

Mrs. Nehala Sharmin, learned counsel for the State appearing through Video Conferencing opposes the prayer and submits that Sainwill Srivastava is accused in several cases and three anticipatory bail filed on behalf of him, has already been rejected. She further submits that innocent persons have been cheated and in view of that anticipatory bail of the petitioner may kindly be rejected. 5. Looking into contents of F.I.R, it transpires that Sainwill Srivastava and Mainwill Srivastava are own brothers and Sainwill Srivastava is said to be director of the said company and allegation against the petitioner is that he is employee of the said company. Identical allegation is against the wife of Sainwill Srivastava namely, Preeti Saxena who has been granted anticipatory bail in A.B.A. No. 3128 of 2025 by a Co-ordinate Bench of this Court. 6. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ranchi, in connection with Gonda P.S. Case No. 47 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
