Heard the parties.
The petitioner has been made accused in connection with Sahibganj (M) P.S. Case No. 45 of 2022, for the offence under Sections 147, 148, 149, 341, 323, 324, 325, 326, 307, 302, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of learned Additional Chief Judicial Magistrate, Sahibganj.
On 10.04.2022, informant alongwith his family members were going to their field. The petitioner alongwith co-accused persons intercepted them. It is alleged that accused persons started assaulting them and subsequently, father of the informant namely Nural Hoda died.
It was submitted that there is no allegation of assault against this petitioner. It was further submitted that similarly situated co-accused persons have been granted bail by this Court as well as the Coordinate Bench of this Court earlier.
In view of the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Sahibganj, in connection with Sahibganj (M) P.S. Case No. 45 of
2022.
