Affidavit-of-service filed in Court today be kept with the record. Report submitted by the learned advocate appearing for the State be also kept with the record. Petitioner has complained against his relations for changing the nature and character of the property. However, they have not been made respondents in this writ petition. State has submitted a report which reflects that a proceeding under Section 163(2) of BNSS was filed by one Ajayendra Tola. The genesis of all the disputes relates to ancestral undivided property wherein no demarcation exists. The petitioner is apprehensive regarding his portion of the property being grabbed by the others. Be that as it may, police authorities would in the circumstances only restrict themselves by keeping surveillance that there is no violation of law and order. With the aforesaid observations, the writ petition being WPA 19536 of 2025 is disposed of. There will be no order as to costs.
2 A copy of the report be handed over to the learned advocate appearing for the petitioner. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
