Notice. Mr. Rajat Choudhry, learned Assistant Advocate General, appears and waives service of notice on behalf of the respondents.

Petitioner feels aggrieved against respondents’ decision as reflected in office letter dated 20.09.2025 (Annexure P-3 Colly.), denying him the benefit of Assured Career Progression Scheme (ACPS). Learned counsel for the petitioner submitted that petitioner’s case for grant of ACPS is covered in terms of the decision rendered in Sanjay Kumar Versus State of Himachal Pradesh & others2.

Learned counsel further submits that the petitioner would be satisfied in case he is permitted to make a representation to respondent No.2/competent authority and the said authority is directed to consider the same in light of the above decision within a fixed time schedule. Learned Assistant Advocate General is not averse to this prayer.

Having regard to the afore-submissions, but without examining the merits of the matter and notwithstanding office letter dated 20.09.2025 (Annexure P-3 Colly.), this writ petition is disposed of by permitting the petitioner to file a representation to respondent No.2/competent authority within two weeks from today, whereafter, the same shall be considered and decided by the said authority in accordance with law as well as taking into consideration the above judgment in Sanjay Kumar2 within a period of six weeks thereafter. The decision so arrived at shall also be communicated to the petitioner.
The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
