1. The limited submissions made by the counsel for the petitioner is that vide order dated 16.12.2023 penalty was imposed against the petitioner in the departmental enquiry proceeding and he has been compulsorily retired from service, against which he has made his representation on 13.05.2025 before the respondent No.3 which is pending consideration and therefore the respondent No.3 may be

Learned counsel for the State though objected on merits, however he does not have any objection if such a direction is given to the respondent No.3 to decide the pending appeal of the petitioner within stipulated time period.

Taking into consideration the limited prayer made by the petitioner and also considering the fact that departmental appeal of the petitioner is pending since 13.05.2025, without entering into the merits of the case the respondent No.3 is directed to consider and decide the pending appeal of the petitioner in accordance with law on its own merits after affording opportunity of hearing to the parties concerned within a period of four months from the date of receipt of copy of this order. The petitioner is directed to produce a copy of this order to respondent No.3 within two weeks from today.
