The petitioner is apprehending his arrest in connection with Daily Market P.S. Case No. 29 of 2025, registered for the offence under Section 318(2) of Bharatiya Nyaya Sanhita, 2023, Sections 63 and 65 of Copyright Act and Sections 103 and 104 of Trade Mark Act, pending in the court of learned Chief Judicial Magistrate, Ranchi.

Learned counsel appearing for the petitioner submits that there is no basis or scientific report to suggest that the watches, which were said to have been recovered from the shop of the petitioner are duplicate, rather in the seizure list itself, it has been mentioned that the Sonata watches were seized. He next submits that on this background, the FIR has been registered under the provisions of Bharatiya Nyaya Sanhita, 2023, Copyright Act and Trade Mark Act. He further submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-17 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of keeping the duplicate watches in the shop.

In the seizure list, it has been disclosed that Sonata watches have been seized from the shop of the petitioner, however, allegations are made that duplicate watches have been kept in the shop and further the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-17 of the petition, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Ranchi, in connection with Daily Market P.S. Case No. 29 of 2025, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
