In view of the order, which is being proposed to be passed, notices are not being issued to O.P. No. 2 to 6. 3. This is an application filed under Section 528 of BNSS for expeditious disposal of the Complaint case no. 2983 of 2021, Under Section 138 N.I. Act, (M/S Rajeev Enterprises vs Bhagawati Prasad Sharma and others), Police Station Delhi Gate, Aligarh pending in the Court of Learned Additional Court, Aligarh within stipulated period to be fixed by this Hon'ble Court. 4. Learned counsel for the applicant submits that as per the mandate contained under Sub-Section (3) of Section 143 of the N.I. Act, the proceeding under Section 138 of the N.I. Act is to be decided within a period of six months from the date of the filing of the complaint case but the same is lingering on. 5. Learned A.G.A. has no objection to the same. 6. Considering the submissions, the application is being disposed of requiring the Additional Court, Aligarh to decide Complaint case no. 2983 of 2021, Under Section 138 N.I. Act, (M/S Rajeev Enterprises vs Bhagawati Prasad Sharma and others), Police Station Delhi Gate, Aligarh. The order is subject to legal impediment, if any, within the time stipulated under Section 143(3) of N.I. Act. 7. Passing of this order may not be construed that this Court has adjudicated the matter on merits.
