The petitioner is before this Court seeking for the following reliefs: i) Issue a writ of certiorari or any other writ or direction in the nature of writ to quash impugned order No.KREIS/ENQR/DISP/ 79/ 2025-ADMN/E-243767, dt.29.08.2025 (Annexure-L) passed by the 2nd respondent, and pass appropriate orders by allowing this writ petition in the interest of justice. - 3 - HC-KAR NC: 2025:KHC-D:11588 WP No. 106516 of 2025 ii) Issue a writ of mandamus directing the respondent to permit the petitioner to report for the duty and permit him to discharge the duty in the post held by him prior to passing the impugned order; and iii) Grant such other or further relief as this Hon’ble Court may deem fit in the circumstances, including costs. 3. The sole ground on which the petitioner is before this court is that the petitioner, though was the Principal of Morarji Desai Residential Science College, Muchakhandi in Bagalkote Taluk and District from 07.07.2025, he was deputed as the Principal of Dr.B.R Ambedkar Residential School, Mustigeri in Badami Taluk of Bagalkote District and he took charge once again as the Principal of Morarji Desai Residential Science College on 22.08.2025. The allegation made against the petitioner is in pursuance of the inspection carried out by the Lokayukta team on 09.08.2025. The petitioner was not discharging his role as the Principal of Morarji Desai Residential Science College - 4 - HC-KAR NC: 2025:KHC-D:11588 WP No. 106516 of 2025 at the relevant time, and as such, no order of suspension could be made against the petitioner. 4. A perusal of these 15 items would indicate that the services which were required to be provided at Morarji Desai Residential Science College, had not been so provided for a long period of time, even prior to 07.07.2025, as on which date the petitioner was the Principal. Thus, reading of Annexure-L does not indicate that the dereliction of duty alleged against the petitioner was not only between 07.07.2025 and 22.08.2025, but appears to be for an earlier point of time also. 6. In that view of the matter, the issues which have been flagged at Annexure-L being for an earlier point of time, the above ground is unsustainable. Hence, the petition stands dismissed.
