Neutral Citation No. (2025:JHHC:33286) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 9911 of 2025 Nikhil Kumar Gupta, aged about 28 years, son of late Madan Kumar Gupta, resident of Manjhi Tola, Chandni Chowk, Adityapur, P.O. & P.S.- Adityapur, District- Saraikella-Kharsawan … Petitioner - Versus - The State of Jharkhand … Opp. Party ------ CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH ----- For the Petitioner : Mr. Vikash Kumar, Advocate For the State : Mrs. Kumari Rashmi, A.P.P. --- 02/07.11.2025 Heard the parties. The petitioner has been made accused in connection with S.T. Case No.201 of 2022, arising out of Adityapur P.S. Case No.136 of 2022, corresponding to G.R. Case No.568 of 2022, for the offences registered under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Chargesheet has been submitted under Sections 302/201/109/120B and 34 of the I.P.C. and Sections 25(1-B) a /26 / 27/35 of the Arms Act, pending in the court of learned District & Additional Sessions Judge-II, Seraikella. Bail Application of the petitioner was earlier twice rejected by this Court. The husband of the informant was murdered by unknown persons outside his house. During the course of investigation, petitioner was apprehended and, on his confession, the diamond ring, belonging to the deceased was recovered. It further appears that the petitioner was put on T.I. Parade and he was identified by the informant as one of the assailants. Learned counsel for the petitioner submitted that petitioner was identified in T.I. Parade after three months. It was further submitted that 18 charge sheeted witnesses have been examined and this case is pending for examination of remaining four witnesses. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail stands rejected. Learned trial court shall take all possible steps to secure the attendance of remaining witnesses and disposed of this case at the earliest. (Ambuj Nath, J.) 7th November, 2025 Jay/-
