The writ petition is filed to declare the action of respondent No.2 instructing the other official respondents not to grant building permission, registration of lease/sale agreement, and mortgage registration to the petitioners, as illegal and arbitrary. 3. The petitioners herein are residents of the Eluru Town Automobile Mechanics Association (hereinafter referred to as ‘Association’). Respondent No.1, to develop and establish Auto Nagar at Eluru, acquired the property of an extent of Ac.54.54 cents in Sy.Nos.4/1 to 4/6, 5/1 to 5/2, 260/1, 260/2, 261, 262/1, 262/2, 263, 264/1 and 264/2 at Malkapuram Village, Eluru Road, West Godavari District, and handed over possession of the property to the Association under registered agreement of sale dated 09.08.2007, because of circular No.296/DW/2000 dated 19.05.2000. Thereafter, the Association registered individual plots to its members, including the petitioners herein. While the matter stood thus, the APIIC vide proceedings in Lr. No.ZM/APIIC/KKD/AN/Eluru(Allot)/2013, dated 28.12.2016, cancelled allotment of land made in favour of the Association. Challenging the said proceedings, the Association filed W.P.No.3748 of 2017. 4. After considering the case facts and legal aspects, this Court allowed the said writ petition, setting aside the proceedings impugned therein.
It was further observed that the respondents therein or other local authorities shall consider granting building permission or other required permissions to establish industrial units to the members of the association, strictly as per law. Page 3 of 4
