1. By way of the present petition, the petitioner has prayed for the following reliefs:- 10.1 That, this Hon’ble Court may kindly issue an appropriate writ, order, or direction restraining the respondents from carrying out any construction work or installation of transmission lines/towers on the petitioners private land without following due process of law. 10.2 That, this Hon’ble Court may kindly direct the respondents to remove any illegally constructed structure or installation already made on the petitioners land. 3 / 4 10.3 Any other relief which the Hon’ble Court deems fit and proper under the facts and circumstances may also be provided to the petitioner. 2.
The grievance of the petitioners is that the petitioners are the owners of the land bearing Khasra Nos.303, 1040/1, 40/1, 273/4, 497/1, 1026/4, 763/5, 1027/2, 1031/2 situated at Village Kharora & Math, Tehsil Kharora, District Raipur,C.G. and the Respondent No.4 without acquiring the land of the petitioners and without any information, permission, order or agreement for erection and construction of power transmission line at Kharora in accordance with the provisions of Electricity Act read with the respective provisions of Indian Telegraph Act. The above land has not been acquired by the Respondent No.4 for the purpose of construction and erection of power transmission unit/line also no compensation has been provided to the petitioners. 3. At this juncture, learned counsel for the petitioners would submit that he would confine his prayer for seeking a direction towards the respondent authorities to decide the pending representation of the petitioners Annexure P/4. 4. Learned State counsel submits that she has no objection in deciding the representation of the petitioners. 5. I have heard learned counsel for the parties and perused the documents with utmost circumspection. 6. Considering the limited prayer made by learned counsel for the
