PUBLIC PROSECUTOR` The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3, seeking regular bail, in Cr'lme 'No.166 of 2024 of chodavaram-police Station, Anakapalli district. 2. A case has been registered against the Petitioner herein and others for the offence punishable under section 20(b)(ii)(C) 2 r, read with 8(c) and 25 of the Narcotic Drugs and ,Psychotropic Substances Act, 1985 (for short fthe NDPS Act'). 3. Case of the prosecution, in brief, is that, on 27.06.2023, at about 16.00 hours, on credible information, the Sub-Inspector of Police, Chodavaram Police Station, along `with his Staff and mediators, while conducting vehicle checking at Gowripatnam junction, outskirts of Narsayyapeta village, Chodavaram Mandal, found Al and A2 in possession and illegal transportation Of 21 Kgs of Ganja in a Eicher Van bearing registration No.KA 51 AG 2183. Al confessed that he secured the Ganja from A3. The contraband along with vehicle and other material was seized and a case has been registered against the accused. 4. Heard. Perused the record. 5. A perusal of the material on record goes tO Show that basing on the confessional statement of co-accused the name Of the petitioner herein was shown as accused in the present crime. Petitioner herein was arrested in connection with another crime on 09.08.2O24.+ Thereafter, the petitioner was remanded to judicial custody in this crime on execution of PT warrant on 17.09.2024. Petitioner has been languI-Shing in jail Since then. I-33S32z:2 3 I/ Learned Assistant Public Prosecutor submitted that major POrtl'On Of inVeStigatl'On has been completed. 6. ln view of~'the aforesaid facts and circumstances of the case, this`Courf is inclined to-grant bat-I tO the Petitioner/A3 on the following conditions. i) The petitioner/A3 shall be released on bail on his executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of` the learned I Additional District and Sessions Judge-Gum-special Judge for trial of offences under the NDPS + Act, Visakhapatnam. ii) On release, the petitioner shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 7.
