Neutral Citation No. - 2025:AHC:53735 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 3555 of 2025 Petitioner :- Smt. Ronika Dixit Respondent :- Mudit Dixit Counsel for Petitioner :- Abhishek Singh,Ronak Chaturvedi Hon'ble Rohit Ranjan Agarwal,J. This writ petition has been filed with the following prayer: "Issue an order or direction upon the Additional Principal Judge, Family Court-1, Ghaziabad to expedite and conclude Divorce case (Marriage Petition) no. 179 of 2023 "Smt. Ronika Dixit vs. Mudit Dixit", under section 27 of the Special Marriage Act expeditiously within a time bound period as may be directed by this Hon'ble Court." It is contended that the petitioner and respondent were married under the provisions of Special Marriage Act on 18.10.2007. Due to matrimonial dispute, the parties are living separately. A divorce petition was moved under Section 27 of Special Marriage Act, which is pending consideration. The sole prayer made in the writ petition is for expeditious disposed of the said petition. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Additional Principal Judge, Family Court-1, Ghaziabad to decide Marriage Petition No.179 of 2023 (Smt. Ronika Dixit vs. Mudit Dixit), in accordance with law, after hearing all affected parties, preferably within a period of six months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
