JUSTICE ANIL KUMAR SINHA ORAL ORDER 5 07-04-2026 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. 2. This application for grant of anticipatory bail, arises Patna High Court CR. MISC. No.61138 of 2025(5) dt.07-04-2026 4/5 out of Kochas Police Station Case No. 123 of 2023, disclosing offences under Sections 143 and 379 of the Indian Penal Code. 3. As per the First Information Report lodged by one Satyendra Kumar Rai, is that on 12.12.2022 he took a piece of land on lease in a government auction for the purpose of cultivation having Khata Nos. 79 and 128; Khesra Nos. 36, 40, 56, 64, 134, 170, 174 and 877; area 82.50 acres. The Rabi crop became ripe and was ready to be harvested. On 10.04.2023 in the morning, when the informant went to inspect his farm, he found that the entire Rabi crop from his land was harvested illegally by the petitioners and other accused persons. 4. Learned Counsel for the petitioners submits that there is a bona fide civil dispute between the parties inasmuch as the petitioners are the red card holders and the landless person. The purchas have been issued in favour of the petitioners for the subject land. Similarly situated co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Hon’ble Court vide order dated 28.10.2024, passed in Cr. Misc. No. 74262 of 2024. 5. Considering the nature of allegation and the fact that similarly situated co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Hon’ble Court, Patna High Court CR. MISC. No.61138 of 2025(5) dt.07-04-2026 5/5 I am inclined to grant the petitioners privilege of anticipatory bail. 6. This application is, accordingly, allowed. 7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousanud) each with two sureties of the like amount each to the satisfaction of learned 19th Additional Sessions Judge, Rohtas at Sasaram, in connection with Kochas Police Station Case No. 123 of 2023, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
