THIS WRIT PETITION HAVING BEEN HEARD AND RESERVED FOR ORDERS ON 24.02.2025, COMING ON FOR PRONOUNCEMENT THIS DAY, THE COURT MADE THE FOLLOWING:- 3 CORAM: THE HON'BLE MR JUSTICE M.NAGAPRASANNA CAV ORDER The petitioners are before this Court calling in question Note 75 dated 20-03-2023 and consequential approval rendered by the concerned Minister dated 30-12-2023 at Note 86, rejecting change of land use sought by the petitioners. As a consequence thereof, the petitioners seek a mandamus to the respondent to reconsider the proposal of change of land use in terms of the recommendations and reports submitted by various authorities. 2. Heard Sri Vijay Raghav Sarathy, learned counsel appearing for the petitioners and Sri Sharad V. Magadum, learned Additional Government Advocate appearing for the respondent. 3. Facts, in brief, germane are as follows:- The petitioners are said to be agriculturists owning certain pockets of land. The lands owned by the petitioners are in Sy.Nos.610, 617, 618, 630, 622 and 625 by the 1st petitioner; Sy.Nos.614A, 614B, 614C, 613 and 626 by the 2nd petitioner; 4 Sy.Nos.621/1, 609 and 612 by the 3rd petitioner and Sy.Nos.611, 616, 620, 623, 624, 615A, 615B and 619 by the 4th petitioner, all at 76 Venkatapura Village of Kamalapur Hobli, Hosapete Taluk, totally measuring 51.64 acres. The petitioners come together and being desirous of establishment of a Theme Park at Venkatapura Village, a project proposed to promote tourism and to satisfy basic needs of tourism as also to encourage tourists to visit the historical monument in the world heritage site. The world heritage site in the case at hand is Hampi World Heritage site. To oversee the management of lands surrounding the heritage area, an authority is constituted called as Hampi World Heritage Area Management Authority (‘the Authority’ for short) pursuant to promulgation of an Act called Hampi World Heritage Area Management Authority Act, 2022 (hereinafter referred to as ‘the Act’ for short). The lands of the petitioners are agricultural lands. If the project had to be approved, the petitioners at the outset have to seek change of land use. Therefore, the petitioners submitted application/proposal along with all necessary documents to the Authority on 02-03-2020. On the application submitted by the petitioners for change of land use under Section 14A of the Karnataka Town and 5 Country Planning Act, 1961 (‘the Planning Act’ for short), the proposal is said to have been examined and necessary paper publication was issued by the Authority seeking for objections from general public. It appears that no objections were received from any quarter. A meeting of the Authority was convened to consider the proposal of the petitioners bearing in mind the mandate of the Act. It is later the Authority recommends to the Government through Planning Department, to accept the request for change of land use. Before the recommendation could come up, several authorities had given their approval, is the averment in the petition along with documents appended to that effect. The Archaeological Survey of India is said to have conducted a joint survey and submitted a report on 18-05-2020. The report of the joint survey was also considered while recommending. The Planning Authority of the Government of Karnataka after examination of the proposal is said to have raised some queries and sought explanation from the hands of the Authority. The Authority again re-examined the proposal and re-submitted the recommendation to the Government on 30.03.2022. Therefore, this forms complete details of the recommendation. These recommendations were forwarded to the 6 Karnataka State Pollution Control Board to examine any objection for change of land use. The Pollution Control Board is said to have approved the same. All necessary authorities have furnished their opinion and the opinion forms part of the recommendation. This was placed before the Secretary, Department of Urban Development/the respondent. It appears that the Secretary has turned it down on the ground that several authorities have not opined and the Committee constituted by the Authority had not looked into various aspects. These proceedings would lead to rejection of representation seeking change of land use of the petitioners though no order rejecting the proposal has been communicated to the petitioners. Therefore, they are before this Court seeking the aforesaid prayer. 4. The learned counsel appearing for the petitioners would vehemently contend that what is necessary in law has even been put in place before the Authority. All that was necessary was appropriate examination of records and drawing up of approval. The respondent ignoring various aspects has perfunctorily recommended rejection of change of land use. The reasons 7 rendered by the Secretary for rejecting change of land use are all contrary to law. He would submit that the growth of tourism should not be stifled by the respondent, when it is not affecting or coming within the restricted area or the protected area of the monument. It comes within the buffer zone. There is no prohibition in law to permit change of land use from agriculture to other of the lands coming within the buffer zone. He would, therefore, submit that the entire decision requires re-consideration. 5. Per contra, the learned Additional Government Advocate representing the State would take this Court through the detailed statement of objections and seeks to place reliance upon the Act and judgment of the Apex Court in the case of SAKKUBAI v. STATE OF KARNATAKA1 and the judgment of the Division Bench of this Court in SRI LAKSHMI GOLDEN BEACH RESORT v. THE COMMISSIONER, HAMPI WORLD HERITAGE AREA2 to buttress his submission that such projects should not be permitted as there would be inflow of tourists and endanger the monument. It is his submission that it comes within the area which is restricted as 1 (2020) 11 SCC 124 2 W.A.No.100035 of 2020 decided on 29-06-2020 8 interpreted by the Apex Court and the Division Bench. He would further contend that the Secretary/respondent has returned the proposal back to the Committee and, therefore, it is not conclusive that the Authority has opined that the project should be given a green signal. He would seek dismissal of the petition and leave the decision to be taken by the State in the interest of protection of the monument. 6. I have given my anxious consideration to the submissions made by the respective learned counsel and have perused the material on record. 7. The link in the chain of events and the dates are not in dispute and they would not require any reiteration. The petitioners who own certain pockets of lands as narrated hereinabove, apply for change of land use to establish an entertainment destination around the area in the lands coming within the precincts of the Authority. The application is filed by the petitioners on 02-03-2020. On filing of the application seeking change of land use under Section 14-A(1)(c) of the Planning Act, objections are called from 9 general Public or stake holders. No objections are received. Therefore, recommendation comes to be made by the Authority to permit change of land use. The resolution of the Authority on the application is germane to be noticed. It reads as follows: “Site Suitability study: The current use of the land is for agricultural purposes and it is a gently rolling topography which has no features such as boulders and rocks. Though the site falls within the buffer zone of the World Heritage site, there are no visible evidences of any archaeological monuments or inscriptions, etc. There are no structures of any historical or cultural importance visible within the site. Located between two hills, the site itself lies in a depressed zone, making it visually protected from the surrounding landscape. Within the immediate vicinity of the site too, there are no visible evidences of any historical or cultural importance. The site lies well away from the normal tourist circuit within the World Heritage site. so any development-on the site would not negatively impact the cultural authenticity of the World Heritage site. Site Feasibility Study: The proposed project in the said site to promote tourist and to satisfy the basic needs of tourist. This project is website developed to promote tourist services in internet and also to increase the movement of tourists by encouraging the tourists to visit the historical monuments in world heritage site and also to visit the natural heritage on Anegundi side. The project also creates the local employment. While so doing, what forms the fulcrum of the reasons is found in Note-75. Note-75 reads as follows: “Note # 75 74 is agreed. moreover, there is no provision in the ZR to change the land use as proposed to commercial and entertainment 14 a of ktcp act 1961 provides for clu in certain cases, this proposal does not fall under the provisions of 14A as there is no such development in and around the said land. ASI has written that any development within the purview of operational guidelines of UNESCO may be viable. this a generalized statement, we have asked to given specific opinion about this said land, it has not come yet. there is no opinion from tourism department regarding the proposal. objections and complaints have been received from public on this proposal, it is referred to hwama authority, they have not replied yet. 23 for reasons explained above the proposal may be rejected in the interest of protecting world heritage area.” (Emphasis added) Note-75 ignores the fact that all the authorities pursuant to the directions of the Authority have examined the proposal and recommended. The chart with regard to transfer of the application from its submission till Note-75 is as follows: “Sl. After satisfaction with the reply and necessary information, the Deputy Secretary sought approval Note 24. for at Note 24 2 16.12.2022 25 1. Sought clear opinion from the DTCP whether in the buffer 1. As per the directions, the Chief Conservator of Forests The same was submitted for the Joint Director of 24 zone, change of land is permissible. 2. Since the land is abutting Tungabhadr a to Otter Reserve etc., whether activities endangering the wild life and get the opinion. given his opinion for change of land use with certain conditions (kindly see Note Al 42 dt:16.02.20 23), 2. The HWHAMA Competent Authority under the Act clearly given the opinion that, the commercial activity can be permitted at the buffer zone and further stated change of land use will not defeat the object of the Act, kindly see Note 42, Dt:16.02.2023 the Planning Division. Along with the same, opinion is sought from the Law Department, the Law Department has given opinion stating that, the change of land use may be permitted subject to the orders of the Hon'ble Courts. 3 11.03.2023 57 To take opinion of Superintendent of ASI and also legal counsel of HWHAMA The same was been communicated to the Superintendent of Archaeologists, Archeological survey of India by letter dated 16.03.2023. The Secretary on 17.03.2023, of noted that, "Await reply". for 4 17.03.2023 66 The Deputy Secretary directed t to resubmit the The Secretary approved the Note 66 at Note 67 dated 17.03.2023. Awaiting the said compliance, Secretary 25 proposal considering the operational guidelines issued by UNESCO. within 2 days, rejected the proposal of change of land use on 20.03.2023. 5 18.03.2023 71 Objections of the general public taken note of that, the general public one Mrs. Neelappa has taken note. The letter written to the Deputy Commissioner, Vijayanagar seeking his opinion for the said objections. Awaiting the said compliance, Secretary within 2 days, rejected the proposal of change of land use on 20.03.2023. 6 20.03.2023 73 Secretary stated examine HWHAMA Act, regulation, Zonal ASI letter and circular dated 12.01.2012 The Joint Secretary without considering the earlier recommendations by the competent Authority without considering the earlier notes, arbitrarily recommended for rejection of the proposal at Note 74. Kindly see Note 74. The Secretary only relying upon the note of the Joint Director at Note - 74, rejected the proposal arbitrarily - without considering earlier opinion, documents, clarification etc. at Note 75 dated 20.03.23.” 26 It is not in dispute that various Departments, Pollution Control Board and Archaeological Survey of India have given their green signal to the project. But the red flag is raised by the respondent. The reason is found at Note-75 supra. The reason nowhere records what is the decision of the Committee/Authority while recommending the proposal. Therefore, it becomes necessary to notice who is the Authority. The Authority is defined under the Act. Section 3 of the Act deals with constitution and incorporation of the Authority and reads as follows: “3. Constitution and Incorporation of the Authority.—(1) As soon as may be after the appointed day there shall be established for the purposes of this Act, an Authority to be called the Hampi World Heritage Area Management Authority. (2) The Authority shall be a body corporate by the name aforesaid having perpetual succession and common seal with power subject to the provisions of this Act, to acquire hold and dispose of property both movable and immovable and to contract and shall by the said name sue or be sued. (3) The Authority shall consist of the following members, namely:— (a) The Deputy Commissioner of Bellary District Chairperson (b) The Deputy Commissioner Koppal District Vice Chairperson (c) The Director of Archaelogy and Museums. (d) The Director of Town Planning, Bangalore. (e) The Director of Tourism, Bangalore. (f) Superintendent of Police, Bellary, 27 (g) Superintendent of Police, Koppal (h) The Superintending Archaeologist, Archaeological Survey of India, Bangalore (i) The Superintending Archaeologist, Archaeological Survey of India, Dharwad Circle, Dharwad. (j) The Chief Executive Officer, Zilla Panchayat, Bellary (k) The Chief Executive Officer, Zilla Panchayat,Koppal. (l) The Deputy Conservator of Forests, Bellary. (m) The Deputy Conservator of Forests, Koppal. (n) The Commissioner, Hospet Urban Development Authority, Hospet (o) The Superintendent Engineer, Bellary Circle, Bellary. (p) The Deputy Environment Officer, Bellary. (q) The Executive Engineer, Irrigation Department, Munirabad. (r) Head of the Department of Archaeology, Kannada University, Hampi. (s) The Executive Officer, sriVirupakshewara Temple and other allied temples, Hampi. (t) The Commissioner of the Authority Member Secretary (4) The Headquarters of the Authority shall be at Hospet.” The Chairperson is the Deputy Commissioner. The Vice-chairperson of the Authority is from the neighboring District. The Director of Archaeology and Museums, Director of Town Planning, Director of Tourism, Conservator of Forests and all other authorities including Head of the Department of Archaeology and the Executive Officer of the Temple among others are the members. The aforesaid Members form the Authority and the Authority recommends the proposal of 28 the petitioners. One wing of the Government has recommended with all the necessary inputs and the respondent without looking into those recommendations, by Note-75 (supra) rejected the proposal. 8. The learned Additional Government Advocate has placed heavy reliance upon the judgment of the Apex Court in SAKKUBAI (supra). The said judgment would not be applicable to the case at hand as it deals with construction in the core zone or protected area; restricted area surrounding the monument. The present land of the petitioners, even according to the respondent, do not fall within the notified area, protected area or the restricted area as defined under the Act. The respondent’s case is that, it comes within the buffer zone. Therefore, with all these materials available, there could not have been rejection on certain irrelevant considerations. Tourism, no doubt would increase the footfall to the monument. It does not mean that there should be restriction of footfall to any monument but it should be regulated. Tourism cannot be neglected, so is the safety of the monument, the balance has to be generated. The regulating body is the Authority 29 constituted under the Act. The Authority has examined and recommended the proposal. The Authority is headed by the Deputy Commissioner. Therefore, the respondent is required to reconsider the recommendation submitted by the Authority in its proper perspective bearing in mind the provisions of the Act as it is an admitted fact that the lands in which the present project is planned to come up does not fall within any of the areas viz., notified area, protected area or restricted area. It is in the buffer zone. Conversion in the buffer zone, unless found otherwise, would not endanger the monument. In that light, the matter requires reconsideration by the respondent as is sought by the petitioners. 9. For the aforesaid reasons, the following: O R D E R (i) Writ Petition is allowed. (ii) Note-75 dated 20.03.2023 and the entire proceedings in the note sheet of the respondent, and all subsequent actions foundationed upon the said proceedings also, as a consequence, stand quashed. 30 (iii) Mandamus issues to the respondent to reconsider the recommendation/proposal of the Authority on the change of land use by the petitioners, bearing in mind the observations made in the course of the order.
