Neutral Citation No. - 2025:AHC:52821 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 3490 of 2025 Petitioner :- Prem Lal And 2 Others Respondent :- Munni Lal Counsel for Petitioner :- Pramod Kumar Vishwakarma Hon'ble Rohit Ranjan Agarwal,J. 1. This writ petition has been filed with the following prayer:- "Issue an order or direction to the court of Additional Civil Judge (J.D.) New court No.11 Jaunpur to decide the original suit No.774 of 1995 (Munni Lal vs. Prem Lal) within stipulated period." 2. It is contended by learned counsel for petitioner that the suit filed by the petitioner being Original Suit No.774 of 1995 is still pending consideration before the court of Additional Civil Judge (Junior Division), New Court No.11, Jaunpur and the suit is at the evidence stage. The sole prayer made in the writ petition is for expeditious disposal of the said suit. 3. Though the Constitution Bench of Apex Court in High Court Bar Association, Allahabad vs. State of Uttar Pradesh and others (2024) 6 SCC 267 has held that Constitution Courts should refrain from fixing a time-bound schedule for the disposal of cases pending before any other courts but looking to the facts of the case, as the civil suit was filed way back in the year 1995 and more than 29 years have elapsed and the suit is at evidence stage, the court below is hereby directed to expedite the proceedings of Original Suit No.774 of 1995 (Munni Lal vs. Prem Lal) and proceed with the matter on day-to-day basis and decide the same, in accordance with law, after hearing all affected parties without granting any unnecessary adjournments to either of the parties, preferably within a period of six months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
