The petitioner has been made accused in connection with Jarmundi P.S. Case No. 62 of 2022, corresponding to Special POCSO Case No. 15 of 2024, for the offence under Section 354A of the Indian Penal Code and Section 10 of Protection of Children from Sexual Offences Act (hereinafter referred to as POCSO Act) and charge has been framed under Section 354(A) of the I.P.C and Sections 10/12 of POCSO Act, pending in the court of Sri Shatrunjay Kumar Singh, learned District and Additional Sessions Judge-I-cum-Special Judge (POCSO Act), Dumka. Bail application of the petitioner was earlier rejected by this Court vide B.A. No. 864/2025, by order dated 11.04.2025 with the liberty to renew his prayer for bail after six months. The petitioner, who is a teacher of the victim, had outraged her modesty on several occasions. It was submitted that the offence alleged is punishable for the maximum period of five years and the petitioner is in custody since December, 2023. Considering the period of custody, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Shatrunjay Kumar Singh, learned District and Additional Sessions Judge-I-cum-Special Judge (POCSO Act), Dumka, in connection with Jarmundi P.S. Case No. 62 of 2022, corresponding to Special POCSO Case No. 15 of 2024. (Ambuj Nath, J.) November 14, 2025 BS/-
