PUBLIC PROSECUTOR (AP) The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 9550/2022 ORDER: The instant petition under Section 482 of the Code of Criminal Procedure, 1973 (in short, “Cr.P.C.”) has been filed by the Petitioners/ Accused Nos. 2 & 3, seeking quashment of the proceedings pending against them in Cr.No. 762 of 2022 of Tadepalli P.S., Guntur District. 2. Heard Sri B.Venkata Rama Rao, learned Counsel for the Petitioners and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. 3. Learned Counsel for the petitioners would submit that the petition may be disposed of by giving protection to the petitioners vide guidelines of the Hon’ble Apex Court in Arnesh Kumar v. State of Bihar1. 4. Learned Assistant Public Prosecutor would submit that because of the stay in this matter, there is no progress in the investigation. The stay may be lifted. The Police may be directed to complete the investigation and file a report. Learned Assistant Public Prosecutor would further submit that offences registered against the petitioners are punishable with less than seven years period of imprisonment and necessary direction may be given to the concerned Station House Officer. 5. Considering the submissions made, the petition is disposed of. However, the Police are directed to proceed with the investigation and file a 1 (2014) 8 SCC 273 3 report according to law. The Police are further directed to scrupulously follow the procedure prescribed under Section 41-A Cr.P.C., [(35 (3) of BNSS] and the guidelines laid down by the Hon’ble Supreme Court in Arnesh Kumar’s case (supra).
