Instant application has been filed by the petitioner-accused Suresh Kaundal, seeking two months more time to comply with the orders dated 17.02.2025 [passed in Cr.M.P. No.441 of 2025] and the subsequent orders dated 23.05.2025 [passed in Cr.M.P. No.1921 of 2025] whereby, the petitioner on account of reasons spelt out in this application, could not deposit the amount in terms of the aforesaid orders.

Perusal of Paras 3 and 4 of the instant application deal the reason which prevented the petitioner for not complying with the orders dated 17.02.2025 and 23.05.2025 earlier.

Petitioner-accused, who is present in Court today, has filed another application
i.e. [Cr.M.P No.4997 of 2025 which is listed today] revealing that as per Annexure P-3 dated 03.11.2025, an amount of Rs.37,500/- [Rupees Thirty Seven Thousand Five Hundred] stands deposited before the Registry of this Court [in addition to the amount of Rs.50,000/- already remitted] on 08.09.2025. Application is duly supported by an affidavit.

Upon listing of this application,
Learned Counsel for the respondent-complainant, does not dispute the above factual position regarding the compliance of the orders dated 17.02.2025 and 23.05.2025 passed by this Court.

Taking into account the entirety of the
facts and circumstances and the subsequent findings, this Court is of the considered view that since the petitioner-accused-Suresh Kaundal has complied with the orders dated 17.02.2025 and 23.05.2025, therefore, in view of the compliance of the orders passed by this Court, the instant application, seeking extension of two months further time has become infructuous and this
application [Cr.M.P. No.4396 of 2025] is accordingly, disposed of.

Instant application has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita against the order dated 09.06.2025 passed by the Learned Judicial Magistrate First Class, Court No.3, Mandi, in Cr.M.A. No.1947 of 2024, titled Uday Ram versus Suresh Kaundal whereby, Learned Trial Court had issued the Non-Bailable Warrants to the petitioner-accused- Suresh Kaundal hereinabove, for non compliance of orders dated 17.02.2025 passed by this Court.

Upon listing of instant application,
Learned Counsel for the respondent-complainant, does not dispute the factual position that the orders dated 17.02.2025 and subsequent orders dated 23.05.2025 have been made by petitioner-accused, by remitting the amount in the Registry of this Court.

Taking into account the undisputed
facts that the petitioner has already remitted/ deposited the amount in terms of orders dated
17.02.2025 in Registry of this Court, therefore, Non-Bailable Warrants issued by Learned Judicial Magistrate First Class, Court No.3, Mandi, are quashed and set aside, so far as it relates to the proceedings, instituted against the petitioner- accused originating from cheque in question, in the instant case.
In aforesaid terms, the instant application is disposed of.

In view of the orders passed hereinabove, Learned State Counsel to inform the State Authorities of the passing of this Order.
List the matter after three weeks before appropriate Bench as per Roster.
