Petitioner was convicted for an offence punishable under Section 302 IPC, which led to his dismissal from service vide order dated 31.01.2018, passed by Zila Panchayat Raj Adhikari, Laksar, District Haridwar. 4. Petitioner has challenged his conviction in an appeal, which is pending before Hon’ble Allahabad High Court. Petitioner was released on bail, pursuant to an order passed by Hon’ble Supreme Court. Petitioner completed 60 years of age, which is the age of superannuation of a Government servant, in the month of January, 2021. 5. By means of this writ petition, petitioner has sought the following reliefs:- “I. Issue a writ, order in the nature of Certiorari quashing the order dated 31-01-2018 passed by respondent no. 3 (Annexure no. 2 to this writ petition). II. Issue a writ, order in the nature of mandamus directing the Respondents to release Pension of petitioner as per service of the petitioner. III. Issue a writ, order in the nature of mandamus directing the Respondents to release the G.P.F., Leave Encashment, Gratuity and Insurance and other retiral dues as petitioner being entitled.” 2025:UHC:7587 6. Learned State Counsel submits that the conviction recorded by Trial Court against the petitioner has not been set aside, even though, petitioner’s appeal is pending before Division Bench of Hon’ble Allahabad High Court. 7. Learned counsel for the petitioner submits that petitioner submitted a Departmental Appeal to the Director, Panchyati Raj, Uttarakhand, who may be directed to consider the Appeal, as per law. 8. Having regard to the limited prayer made by learned counsel for the petitioner, the writ petition is disposed of with a direction to the Director, Panchayati Raj, Uttarakhand to consider and decide petitioner’s Appeal, one way or the other, as per law, within six months from the date of production of certified copy of this order.
