The instant appeal is directed against the Judgment of conviction and Order of sentence dated 30.01.1997 passed by learned Additional Sessions Judge, Sahibganj in Sessions Trial No.44 of 1992/414 of 1993 by which the sole appellant has been convicted under section 302 of the Indian Penal Code and has been directed to undergo imprisonment for life for the offence under Section 302 IPC. 2. One affidavit has been filed on behalf of the State. Drawing the attention thereof, submission has been made that the sole appellant, namely, Sawne Soren @ Sawana Soren has died. 3. No application has been filed by the legal representative to sue the proceeding, as such, the present appeal is abetted. 4.
