CMP(M) No.1531 of 2025 Keeping in view the averments made in the application, duly supported by the affidavit of the official, delay of 104 days in filing the appeal is condoned.
2. The application stands disposed of. LPA No.812 of 2025
3. It is pointed out that the learned Single Judge had relied upon the judgment dated 21.08.2023, passed in CWPOA No.5507 of 2020, titled Oma Wati and another Vs. State of Himachal and others, whereby the benefit of the annual increments was given for the period of contract services which was to be counted for the purpose of pensionary benefits only.

It is fairly pointed out that though in Oma Wati’s case (supra), the Special Leave Petition (SLP) has been dismissed but in another Special Leave Petition (Civil) Diary No(s). 8008/2025 titled State of Himachal Pradesh & Others Vs. Ram Chand & Others arising out of LPA No.232 of 2024 titled Ram Chand & others Vs. State of H.P. & Others, decided on 02.09.2024, the Apex Court has stayed the directions of this Court to count increments.
5. Issue post admission notice to the respondents, returnable within four weeks, on taking steps within one week. CMP No.21520 of 2025
6. Keeping in view the above, we allow the said application and direct that the benefit of increment portion as such of the respondents-employees, till further orders, shall remain stayed. CMP No.20789 of 2025.
7. In view of the above, the application stands disposed off accordingly. LPA No.812 of 2025
