1. Heard Mr. Vikash A. Shrivastava, learned counsel for the petitioner. Also heard Mr. Shashank Thakur, learned Deputy Advocate General for respondents / State.
2. The petitioner has filed the present petition with the following prayers :
“10.1 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus or direction to the respondent authorities to reserve one seat for the or given provisional admission to the petitioner in the B.Tech. Civil Engineering course at C.G. Institute of Technology Jagdalpur Distt. Bastar, pending the declaration of the supplementary examination result for Class-12 Physics. 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to allow the petitioner to submit the Class-12 certificate upon declaration of the supplementary exam result and confirm his admission based on the provisional seat allotment. 10.3 That, any other relief in favour of the petitioner, which this Hon'ble Court deemed fit and just in the
facts and circumstances of the case.”
3. Brief facts of the case are that the petitioner is a Class-12 student in the Mathematics stream at Nirmal Higher Secondary School, Bastar (C.G.). He appeared for the Senior School Certificate Examination 2025 conducted by the Central Board of Secondary Education but received a supplementary result in Physics. The petitioner appeared for supplementary examination on 15.07.2025, but result is still awaited. The petitioner participated in Pre-Engineering Test (PET) with Roll No. 2515701000661
3 conducted by Technical Education Department and the petitioner obtained CG State Rank 1208. The respondent department conducted second round of C.G. B.Tech. Counselling-2025 on 16.07.2025 and the petitioner was allotted a provisional seat allotment letter, as per which, he was allotted Vishwavidyalaya Engineering College, Ambikapur for B.Tech. Civil Engineering course. The petitioner sought admission to the aforesaid course but was denied by the respondent department due to the absence of a Class-12th certificate. Despite the petitioner's request to submit the certificate once the results were declared, the respondent authorities declined to consider the request. The respondent department initiated the third round counseling from 22.07.2025 and the petitioner submitted his registration. The seat allotment letter will be issued on 30.07.2025. Hence this petition.

Learned counsel for the petitioner submits that the respondent authorities' refusal to consider the petitioner's request to submit the Class-12 certificate upon result declaration is unreasonable and fails to account for the petitioner's merit, as evidenced by his CG State Rank of 1208 in the Pre-Engineering Test (PET). Denying the petitioner a reserved seat pending the supplementary exam result will cause irreparable harm, as the petitioner risks losing an academic year, impacting his career prospects and causing undue hardship. Further, educational institutions and counseling authorities have, in similar cases, allowed provisional admissions subject to the submission of pending documents,
4 which the respondents have failed to consider in this case, violating principles of natural justice. Ensuring access to education for meritorious students, especially when delays are caused by external factors like result announcements, serves the larger public interest and promotes fairness in the education system.
5. Learned counsel for the respondents strongly opposes the
submissions made by learned counsel for the petitioner and submits that reserving a seat or granting provisional admission would not be feasible. The petitioner is aware that the admission process requires a Class 12 certificate, and the delay in the supplementary exam result is not the responsibility of the institute or authorities. The requirement of a Class 12 certificate is a fundamental eligibility criterion for admission to the B.Tech. program. Relaxing this requirement for individual cases could compromise the integrity of the admission process. Further, reserving a seat for this petitioner could set a precedent that might be difficult to manage fairly for other students in similar situations. Accommodating such requests could impose additional administrative burdens and potentially disrupt the academic calendar. As such, the petitioner's request for reserving a seat or provisional admission should be denied.
6. Heard learned counsel for the parties and perused the documents appended with the petition.

7. In view of the above, this Court is not inclined to allow the petitioner's request for reserving a seat or granting provisional admission in B.Tech. Civil Engineering course at C.G. Institute of Technology Jagdalpur, Distt. Bastar. The petitioner's circumstance, though unfortunate, does not warrant an exception to the established admission criteria. Further, reserving a seat for this petitioner could set a precedent that might be difficult to manage fairly for other students in similar situations. Accommodating such requests could impose additional administrative burdens and potentially disrupt the academic calendar. As such, we are of the view that no seats can be reserved for cases involving delayed examination results, as it would undermine the integrity and fairness of the admission process.
8. Accordingly, the instant petition is dismissed.
