Pangu, learned Government Advocate, Arunachal Pradesh, appearing for the respondent Nos. 1 to 3 and Ms. Y. Gao, learned counsel appearing on behalf of Mr. M. Kato, learned DSGI appearing for the respondent No. 4. 2. As agreed to by the learned counsel for the parties, the present writ petition is taken up for final consideration and is being disposed of by this order. 3. The petitioner in the present writ petition has prayed for a direction upon the respondent authorities for compensating him for the damages caused to his property, during the construction of a road from Migging village to Bile in Upper Siang district of Arunachal Pradesh. 4. The petitioner has projected that the Border Roads Organization (BRO), i.e. the respondent No. 4, had initiated a process for construction of border road from Migging village to Bile in Upper Siang district of Arunachal Pradesh. It is projected that during the course of the construction, extensive damages occasioned to the lands of the Villages in the area, including that of the petitioner, herein. It is further projected that the alignment of the road being changed, the construction activities in the area, the land of the petitioner is so located, is presently not being carried out. However, the damages already Page No.# 3/4 caused to the property of the petitioner has till date not being compensated. 5. This Court on the last date of listing, i.e. on 05-08-2026 had required the Government Advocate, Arunachal Pradesh, to receive instruction as to whether a joint verification was carried out to ascertain the extent of damage caused to the land of the petitioner. 6. Ms. Pangu, learned Government Advocate, Arunachal Pradesh, on instruction, submitted that no such joint verification has been carried out till date. 7. In view of the above, the damages alleged to have been caused to the property of the petitioner not having been ascertained, this Court is of the considered view that the present writ petition need not be required to be detained for further adjudication and can be disposed of by requiring the respondent authorities to carry out a joint verification of the property of the petitioner, so as to ascertain at the first place as to whether any damage has been caused to the same on account of the construction of the road in question carried out by the BRO and thereafter, for assessment of the compensation required to be paid. 8. In view of the above, this Court directs the District Commissioner, Yingkiong, Upper Siang district, Arunachal Pradesh, to constitute a committee involving the officials of the establishment of the District Commissioner, Yingkiong, Upper Siang district, the officials of the BRO and the petitioner, to assess the damage caused to the property of the petitioner on account of the construction of a road in the area, wherein, the said property is located, by the BRO. Page No.# 4/4 9. The said Committee shall carry out a field inspection of the property of the petitioner and thereafter, assess the damage, if any, caused to the said property. On assessment being made, a report, thereof, be submitted to the District Commissioner, Upper Siang district, Yingkiong and the said authority shall now assess the compensation to be paid to the petitioner for the damages so occasioning to his property. 10. The said exercise be initiated and completed within a period of 03 (three) months from the date of receipt of a certified copy of this order. 11.
