The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petition-ers/Al to A4, seeking regular bail, in Crime No.200 of 2024 of DevaraPalli Police Station', Anakapalle district. `* --\ ' \,_ie .ziFiZP - ---_________ _____fro1_ ___`___-----`--,------------__ 2. A case has been registered against the petitI|OnerS herein and another for the offen6es- punishable under sections 20(b)(ii)(C), 25 read wI'th 8(c) of the Narcotic Drugs and psychotropic substances Act, 1985 (for short fthe NDPS ActJ). 3. Caseoftheprosecution, in brief, isthat, on o7.ll.2024, at about 03.00 PM, on credible information, the station House Officer, DevarapaIIi Police Station, Anakapalle district, along with his staff and mediators, reached Siripuram junction, Devarapalli Mandal and found two cars i.e., TATA IALTRdZ bearing registration No.OD 10 U 8901 and Hyundai ilo lCar bearing registration No.OR 05 AD 4499 and on seeing police the car driver of i10 drove the same in a negligent manner and dashed the barricade and stopped the car and fled away while the other Car Was Stopped. On enquiry, the inmates in the car, who are Al to A4, disclosed their identify particulars and police seized 2 Kgs of Ganja in their car and 38 Kgs of Ganja in ALTROZ car in total 40 Kgs. After observing all formalities, police seized the Ganja, arrested Al to A4 and got remanded them to judicial custody. 4. Heard. Perused the record. `\-- Ei= _ 5. Petitioners/Al to A4 were arrested on 07.ll.2024 and since then they are in jail. Learned AssI'Stant Public Prosecutor submitted that there are no antecedents against petitioners herein and major portion of investigation has been completed and charge shleet is not yet filed for want of inventory. 6. ln view of the aforesaid facts and circumstances of the Case, this Court is inclined to grant bail to the petitioners/Al to A4 on the following conditions. i) The petitioners/Al to A4 shall be released on bail on their executing personal' bonds for Rs.10,000/- (Rupees Ten Thousand only) eachJwith two s'ureties of the like sum each to the satisfaction of the learned I Addjtjonal District and Sessions Judge-cum-Special Judge for trial of offences under the NDPS Act, Visakhapatnam. ii) On release, the petitioners sha[[ appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. iii) Petitioners herein/Al to A4 shall not go beyond the jurisdiction of Anakapalli district, Andhra Pradesh State, without leave of th'e special court and they shall make available their I EEEff location through mobile phones by pairing them with the mobile phone of the Investigating Officer round the clock. 7.
