Rahul, Advocate For the State :- Mr. V.S. Sahay, Advocate ---- 03/16.12.2025 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Balumath P.S. Case No.68 of 2025, for the alleged offences registered under Sections 302, 120(B) and 34 of Indian Penal Code pending in the Court of learned Chief Judicial Magistrate, Latehar. 3. Learned counsel appearing for the petitioner submits that the death of the deceased has occurred on 06.12.2023 wherein the complaint case has been lodged on 24.06.2025 which has been sent by the learned Court for registration of the FIR and pursuant to that the FIR has been registered under Section 302, 120(B) and 34 of Indian Penal Code. He further submits that by the last date case diary has been called for and in the case diary only it has come that prior to going to work in Tripura in a brick kiln there were some altercation between the petitioner and the deceased and both are labourers. He then submits that there is no postmortem report and eye witness to the occurrence and the case 2025:JHHC:37790 --2-- A.B.A. No. 5988 of 2025 diary is silent on this point. 4. Learned counsel appearing for the State opposed the prayer and submits that the FIR has already been registered and investigation is going on. 5. Considering that the said occurrence is of 06.12.2023 and the complaint case has been lodged on 24.06.2025 and thereafter on the direction of the Court FIR has been registered and on the point of injury and postmortem case diary is silent and there is no independent witnesses and it has come in the case diary that prior to going to Tripura for working in brick kiln there were altercation between the petitioner and the deceased and both are labourers, I am inclined to provide anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Balumath P.S. Case No.68 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated 16.12.2025 Sangam/
