05/ 22.12.2025: Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Jainagar P.S. Case No. 123 of 2025, registered under sections 126(2), 115(2), 308(2), 190, 191(2), 191(3), 303(2), 324(2), 351(2), 352 of BNS, 2023, pending in the Court of learned SDJM, Koderma.

Learned counsel for the petitioners submits that the land of the petitioners was acquired and compensation was not made and in view of that petitioners was agitating for that false case has been registered against the petitioners on the instigation of MLA, Barhi. He further submits that there is also one case against the petitioner being Jainagar P.S. Case No. 120/2025 and in that case petitioner has been granted anticipatory by the learned Sessions Judge. He then submits that petitioner has got no criminal antecedent except said case. He further submits that for the same allegations different cases have been lodged. He next submits that co-accused persons have been granted anticipatory bail in A.B.A. No. 7182 of 2025. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits

that allegations of extortion and assault are there.

It has been pointed out that on the instigation of MLA, different cases have been lodged for the same allegations. In one of the case, the petitioner has been granted anticipatory bail by the learned Sessions Judge and co-accused persons have been granted anticipatory bail in the aforesaid A.B.A.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within four weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned SDJM, Koderma, in connection with Jainagar P.S. Case No. 123 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
