Sri Shailendra Singh, learned counsel for the applicant on instructions received from his client submits that though the application u/s 528 BNSS has been preferred by the applicant for quashing the entire proceedings of Session Case no. 2230/2023 (Priti Vs. Rishabh and Others) and also to quash the impugned cognizance and summoning Order dated 20.02.2025, passed by Addl. District Judge/ special judge Pocso Act, District- Hamirpur, under section 354 of L.P.C. and under section 10 of Pocso Act, Police Station- Binwar, District-Hamirpur pending Addl. District Judge / special judge Pocso Act, District- Hamirpur, however, he confines his relief for consideration of the bail in the light of the judgment of the Hon'ble Apex Court in Satender Kumar Antil Vs. Central Bureau of Investigation, (2022) 10 SCC 51. 2. Learned AGA and learned counsel for the opposite party no.2 have no objection to the same. 3. Considering the submissions raised at the Bar and the statements so sought to be made by them, the application stands disposed of while observing that in case appropriate proceeding in the form of bail application is preferred before the court below, then the same shall be decided with most expedition strictly in accordance with the law of the land keeping in view the judgment in the case of Satender Kumar Antil (supra).
