JUSTICE DR. ANSHUMAN ORAL ORDER 2 07-05-2025 Heard Learned Counsel for the petitioners and Learned APP for the State. 2. The petitioners are apprehending their arrest in connection with Lakhaura P.S. Case No. 76 of 2014 lodged on 16.03.2024 for the offence punishable under Sections 147, 148, Patna High Court CR. MISC. No.27405 of 2025(2) dt.07-05-2025 2/3 149, 342, 323, 324, 332, 333, 353, 427, 307, 380, 411, 452, 504 and 506 of the Indian Penal Code and Section 3 of Prevention of Damange of Public Property Act. 3. As per the prosecution, FIR has been lodged against 25 named accused persons (including the present petitioners) and 150 unknown persons holding various weapons like Lathi, Danda, Bhala, Farsa in their hand in the leadership of accused Babulal Sahani entered into Police Station premises and started damaging windows, door, glasses, chair, as well as government vehicle and two mobile phones. 4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. He submits in paragraph No.9 of the bail application that this case is of the year 2014 and there are 125 unknown persons who has been made accused in the present case. Counsel submits that during course of the investigation, the Inspector sent requisition on 08.04.2024 to the SHO to add the name of 31 more persons in the case as an accused, who were not named in the FIR and petitioners are out of those 31 persons. He submits that there are no criminal antecedent of the petitioners. Counsel submits that the known accused persons have already been granted by this Hon’ble Court in various cases and the anticipatory bail Patna High Court CR. MISC. No.27405 of 2025(2) dt.07-05-2025 3/3 order has been annexed as annexure-2 series. Counsel further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him. 5. Learned APP for the State opposes the prayer for bail. 6. As such, in the present facts and circumstances of this case, let the above named petitioners be released on anticipatory bail, in the event of their arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the Bharatiya Nagarik Suraksha Sanhita, 2023 to the satisfaction of Learned Chief Judicial Magistrate, Motihari in connection with Lakhaura P.S.
