ORAL ORDER
1. Heard Learned advocate Mr.Jay R. Shah for learned advocate Mr.Jinesh H. Kapadiya for the petitioner.
2. At the outset, learned advocate Mr. Shah appearing states that during the pendency of the present writ application, the Trial Court has dismissed the Regular Civil Suit No.42 of 2004 vide its judgment dated 30.09.2024. He placed the sample copy of the aforesaid judgment passed by Trial Court, which is taken on record. He makes a statement that the present writ applcartion may be dispose of as having become infructuous as the suit is dismissed by the Trial Court, so, nothing survived
C/SCA/12013/2020 ORDER DATED: 19/08/2025 in the matter as having become infructuous.
3. It is made clear that this Court has neither gone into nor examined the merits of the matter and the rights and contention of the respective parties are left to be decided in appropriate proceedings, if initiated.
4. In view of the above, the present writ application is
disposed of as having become infructuous. Notice is discharged. No order as to costs. Interim relief, if any, stands vacated forthwith.
