He claims promotion to the post of Assistant Regional Manager (Finance). He has made a representation in this regard but to no avail. The only prayer made by Shri Viveka Nand Rai, learned counsel for the petitioner is that representation of the petitioner may be decided within a stipulated period of time. Shri Adarsh Bhushan, learned counsel for the respondent no. 2 and 3 submits that the matter requires determination of facts by the competent authority in light of applicable provisions of law in the first instance. However, he fairly contends that service benefit/claim is liable to be decided by the competent authority in a reasonable time frame. In wake of the aforesaid submissions and without going into the merits of the case, the respondent no. 3 is directed to decide the representation of the petitioner regarding grant of promotion after considering all relevant facts including applicable provisions of law, seniority, service records and relevant service regulations in accordance with law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
